We provide protection if under the law the employer is responsible for an accident at work. Whether it is a liability based on fault or risk will be determined by the circumstances of causing the damage.
There may be situations where the employer is liable regardless of their fault, e.g. in case of damage caused by the use of production belts or machinery which determines the qualification of the company as being operated with the use of natural forces. Then - even if it is the employee's fault (unless it is the employee's sole fault) - the employer will be liable for the damage and the employee will be deemed to have contributed to the damage.
If you have paid for the damage caused by the Insured’s subcontractor, you can make a recourse claim against the subcontractor.
This is possible if you have not waived your right of recourse against the insured's subcontractor under special provisions. You are entitled to regress by law.
